Welcome to MKesh India Private Limited (“MKesh”, “Company”, “We”, “Us”, or “Our”). These Terms and Conditions (“Terms”) govern your use of our website www.mkeshindia.com, mobile applications, and any related services, products, or platforms (collectively referred to as the “Platform”). By accessing, browsing, or using our Platform or Services, you (“User”, “You”, “Your”) agree to be bound by these Terms and our Privacy Policy. 2. About MKesh
MKesh India Private Limited is a full-stack fintech infrastructure company providing digital financial services and technology solutions including but not limited to PPI Issuing (Prepaid Cards & Wallets), Merchant Payments (POS, UPI, SoftPOS, Gateway), Financial Inclusion (AePS, Agent-assisted banking, bill payments), Digital Lending (Credit, BNPL, Microloans), and Platform as a Service (PaaS) for fintech integrations. All services are subject to regulatory guidelines, RBI compliance, and applicable laws.
3. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts under Indian law. By using this Platform, You represent that You meet these requirements. If You are using MKesh on behalf of an organization or entity, You confirm that You are authorized to accept these Terms on its behalf.
4. Account Registration and Security
To access certain Services, You may be required to create an account. You agree to provide accurate and complete information during registration and keep it up-to-date. You are responsible for maintaining the confidentiality of Your account credentials and for all activities that occur under Your account. MKesh will not be liable for any loss or damage arising from unauthorized use of Your account. If You suspect any unauthorized access or breach of security, You must immediately notify us at support@mkeshindia.com.
5. Use of the Platform
You agree to use the Platform only for lawful purposes and in compliance with these Terms. You shall not use the Platform for any fraudulent, unlawful, or harmful activities; interfere with or disrupt the operation of the Platform; reverse-engineer, copy, or modify any part of the Platform; attempt unauthorized access to MKesh systems or user data; or upload or transmit viruses, malware, or malicious code. Violation of these Terms may result in suspension or termination of Your access to the Platform.
6. Services and Fees
Certain MKesh services may be subject to applicable service charges, fees, or commissions. All fees shall be communicated transparently before availing the service. MKesh reserves the right to modify pricing, introduce new services, or discontinue existing ones at any time. All payments are processed securely through authorized payment systems.
7. Intellectual Property
All trademarks, logos, service marks, designs, software, text, images, and other content on the Platform are the sole property of MKesh India Pvt. Ltd. or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal or authorized business use only. You shall not reproduce, distribute, or modify any part of the Platform without prior written consent from MKesh.
8. Data Protection and Privacy
Your personal and financial information is handled in accordance with our Privacy Policy, which forms an integral part of these Terms. By using our Platform, You consent to the collection, storage, processing, and use of Your information as per the Privacy Policy.
9. Third-Party Links and Services
The Platform may contain links or integrations to third-party websites or applications. MKesh is not responsible for the content, reliability, or data handling practices of these third parties. You access such links at Your own risk, and their terms and privacy policies shall govern Your use of those platforms.
10. Disclaimers
The Platform and Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. MKesh makes no warranties regarding accuracy, availability, security, or reliability of the Platform or its content. We do not guarantee uninterrupted service or error-free functionality. To the maximum extent permitted by law, MKesh disclaims all liability arising from any errors, omissions, or inaccuracies in content; unauthorized access, data loss, or service interruption; and viruses, malware, or technical malfunctions.
11. Limitation of Liability
To the fullest extent permitted by law, MKesh, its affiliates, employees, and partners shall not be liable for any indirect, incidental, consequential, or punitive damages arising from Your use of the Platform or Services. In no event shall MKesh’s total liability exceed the amount paid by You (if any) for the specific service giving rise to the claim during the 30 days preceding the event.
12. Indemnification
You agree to indemnify and hold harmless MKesh India Pvt. Ltd., its directors, employees, partners, and affiliates from and against any claims, liabilities, damages, or expenses (including legal fees) arising out of Your breach of these Terms, Your misuse of the Platform, or violation of any applicable law or rights of a third party.
13. Suspension or Termination
MKesh reserves the right to suspend, restrict, or terminate access to the Platform or Services without notice if You breach these Terms, engage in fraudulent or unlawful activity, or as required by law or regulatory authority. Upon termination, Your right to use the Platform will immediately cease.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall fall under the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
